1. General

The relationship between the Affiliate and SendPulse is governed by the terms of this Affiliate Program (hereinafter referred to as “The Program"), the SendPulse Privacy Policy, and the SendPulse Terms of Use where applicable.

The SendPulse Affiliate Program aims at promoting and distributing the company’s services and establishes standard conditions for cooperation with SendPulse's Partners, including the amount, procedure, and conditions for accruing and paying commissions for bringing new clients to the Service. The terms of the Program apply to all Partners. SendPulse has the right to approve separate terms of cooperation with a specific Partner set forth in a respective agreement.

The terms of the Program can be changed and supplemented by SendPulse's administration provided that the Partners are notified about such changes. The new version of the Program takes effect from the moment it is placed on the company’s official website. Continued use of the Service and further participation in the Affiliate Program means accepting and agreeing with the Program’s new edition and its possible changes.

2. Definitions

“Partner” means an Agency or Affiliate.

“Agency” means an individual or company participating in the Affiliate Program by bringing new users (existing users of the Service or users, newly registered by the Agency and connected to the "Agency Area"), consulting them on SendPulse's services as well as creating, configuring, and making changes to bulk campaigns and chatbots in acquired customers' accounts.

“Affiliate” means an individual or company participating in the Affiliate Program by engaging new users and encouraging them to register using the Affiliate’s personal referral link.

“User” means an individual or company that was engaged by the Agency (an existing user of the Service or a user, newly registered by the Agency and connected to the "Agency Area") or the Affiliate ( a user who registered using the Affiliate’s personal referral link) and uses SendPulse’s paid plans.

“Balance Replenishment” means a transaction of the User’s funds to be credited to the main balance in the Service.

“Pricing Plan Purchase” means a transaction of the User’s funds with the aim to pay for a specific plan and the email, SMTP, messenger chatbot, web push notification, and website services it provides.

“Pricing Plan Activation” means the activation of a plan by the User using their personal account provided that there are sufficient funds on their balance. If the User purchases a pricing plan, the activation is carried out automatically.

Terms used but not defined herein shall have the respective meanings given to them in the SendPulse Terms of Use and the SendPulse Privacy Policy.

3. Conditions of cooperation for Agencies

SendPulse provides the Agencies with:

  1. Access to the "Agency Area". It is a section in the SendPulse personal account that allows Agencies to log in to the Users’ accounts and create, configure, and make changes to their bulk campaigns and chatbots.
  2. Personal manager’s assistance with the Service and its work.
  3. Commission upon activation of a plan by the Users via email, SMTP service, and chatbots.
  4. Placement of the Agency’s logo in SendPulse’s "Partners" section.
  5. Information partnership, exchange of guest articles and posts, and joint webinars.
  6. The opportunity to get certified by the Service to raise your partner status and receive the 40% commission.
  7. The opportunity to receive up to 50% commission of the cost of the User’s activated plan. Agencies are entitled to this commission if they engage more than ten paying customers.

SendPulse advises that customers submit service requests to certified Agencies as reliable service providers.

Conditions for accrual and payout of the Agencies’ commission:

  1. The amount of commission is at least 30% of the cost of the User’s activated plan. The commission is automatically added after the activation of a plan by the User. It can be approved by the manager responsible if the User's compliance with the Program’s conditions is ensured. The commission may be canceled and not paid to the Agency due to violations of the terms of this Program.
  2. The commission can be used to pay for the Service’s pricing plans.
  3. The commission payout is carried out once a month. There is no minimum commission payout amount.
  4. The commission payout is carried out not earlier than 30 days after the activation of a plan by the User.
  5. The commission can be accrued to a PayPal account.
  6. If the Agency User has received a refund, the commission for this plan activation will be canceled.
  7. If the User switches to another plan that requires funds recalculation, the commission is also subject to recalculation, taking into account the new pricing plan's cost.
  8. If the User purchases an annual plan, the commission is accrued monthly as used.
  9. If the activation of the User's plans costs more than 70% of the Agency's commission total amount, the commission payout may be suspended until the moment when the share of each User is less than 70% of the Agency's total commission.

Terms of cooperation for the Agencies

  1. The Agency and SendPulse communicate using the following email: ok@sendpulse.com. Priority technical support is accessible via live chat on the site and a Telegram chat as agreed.
  2. The Agency is not entitled to look for and engage new Users by participating in tenders, auctions, procurements, and other similar third-party events dedicated to email, SMS, Viber, and WhatsApp campaigns, SMTP service, web push notifications, chatbot and messenger campaigns, email validation, CRM systems, websites (landing pages) development, and other similar services provided by SendPulse.
  3. If the Agency has any doubts as to the extension of these terms to specific tenders, auctions, purchases, and other similar third-party activities, it can be negotiated with the program coordinator: ok@sendpulse.com.
  4. It is forbidden to connect your own accounts to the "Agency Area" to receive a commission.
  5. It is forbidden to use spamming techniques to disseminate information about the Service.
  6. It is forbidden to use SendPulse's content to promote its competitors.

4. Conditions of cooperation for the Affiliates

SendPulse provides the Affiliates with:

  1. Access to the Affiliate Panel, which is a separate personal account that allows you to track the effectiveness of posted links, view referral links, the amount of the accrued commission, and request its payout.
  2. Personal referral link and promo code for the referred Users.
  3. The commission upon the User’s Pricing Plan Purchase and Balance Replenishment in the Service.
  4. The ability to use SendPulse's content (descriptions, screenshots, videos) to promote the company’s services.
  5. Using banners, HTML, Flash, and hyperlinks.

Conditions for accrual and payout of the Affiliates' commission:

  1. The commission amount is 25% of the User’s purchased plan’s cost and 10% of the User's Balance Replenishment amount. The commission for plan activation is not accrued at the expense of the User's balance.
  2. The commission is calculated in the Affiliate Panel automatically and approved by the responsible manager if the User's compliance with the Program’s conditions is ensured. The commission may be canceled and not paid to the Affiliate due to violations of this Program’s terms. The amount of commissions accrued to the Affiliate is displayed in the respective section of the Affiliate Panel.
  3. The minimum commission payout amount is $100.
  4. In the event of a refund to the Affiliate’s User, the commission for their payment is canceled.
  5. The commission payout is carried out not earlier than 30 days after the User’s Pricing Plan Purchase or Balance Replenishment.
  6. If the User purchases an annual plan, the commission is paid monthly as used.
  7. If the payments of one User cost more than 70% of the Affiliate's total commission amount, the commission payout may be suspended until the share of each User is less than 70% of the Affiliate's total commission.
  8. The commission can be accrued to a PayPal account. At the Affiliate's request, the commission can be credited to their balance in the Service.

Terms of cooperation for the Affiliates

  1. The Affiliate and SendPulse communicate using the following email: ok@sendpulse.com or by filling out the forms in the Affiliate Panel.
  2. It is forbidden to use spamming techniques to disseminate information about the Service.
  3. It is forbidden to promote the Affiliate's website using email spam or SEO spam. The Affiliate's website must not violate the laws of the state of which the Affiliate is a citizen or resident.
  4. The Affiliate's website must not infringe copyrights, trademarks, patents, or other intellectual property rights. Affiliates must not register domain names containing the word "sendpulse" or its misspellings.
  5. It is forbidden to use SendPulse's content to promote its competitors.
  6. It is forbidden to use this Program to receive a discount on the Affiliate's own bulk campaign.
  7. The affiliate is prohibited from advertising their personal referral link in PPC systems, including but not limited to Google Adwords, and Bing Ads.
  8. It is prohibited to re-register SendPulse's existing clients for the purpose of earning a commission or use referral links to purchase SendPulse's products for your own use.

SendPulse reserves the right to close an affiliate account at any time with subsequent notification if the Partner violates the terms of this Program or other rules and policies of the Service and uses unethical, fraudulent, or illegal promotion methods.
